  • Negligence — This is the failure to perform competent professional service, resulting in damage to the client or customer.  You have to show that the professional performed far below the standards for his or her field, or made errors that no reasonable member of the profession would make.
  • Breach of contract — Contracts are often used to define performance expectations and the obligations of each party.  A breach of contract occurs when a party to the agreement fails to uphold the agreement.
