  • Breach of fiduciary duty — Attorneys are expected to act in the best interests of the client. When an attorney puts his own interests or those of a third party before your interests as the client, that is a breach of fiduciary duty.
  • Breach of contract — A retainer agreement is a contract that defines the relationship between the lawyer and client.  Like all contracts, it lists the role, expectations and obligations of each party.  A breach of contract occurs when a party to the agreement fails to uphold the agreement.

A common basis for a legal malpractice claim is when an attorney misses a deadline- such as a statute of limitations for filing a paper with the court – and this error is related to a loss suffered.
